Navigation and the transmission of a purchase order on the website imply acceptance of the Terms and Conditions and the Data Protection Policies adopted by the site as indicated herein.2. These General Terms and Conditions of Sale apply to the sale of products exclusively for purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree No. 206/05 as amended by Legislative Decree No. 21/14 and Legislative Decree 70/03).3. The user is required to read these General Terms and Conditions of Sale before accessing the products provided by the site, which are generally and unequivocally deemed accepted at the time of purchase.4. Users are invited to download and print a copy of the purchase form and these General Terms and Conditions of Sale, the terms of which tenutaorzale.it reserves the right to modify unilaterally and without notice.

Art. 2 – Subject

These General Terms and Conditions of Sale govern the offer, forwarding, and acceptance of purchase orders for products on tenutaorzale.it and do not govern the provision of services or the sale of products by parties other than the seller, which may be present on the same site via links, banners, or other hypertext connections.2. Before placing orders and purchasing products and services from parties other than the seller, we suggest checking their terms of sale.

Art. 3 – Conclusion of the Contract

1. To conclude the purchase contract, it is necessary to fill out the electronic form and transmit it by following the relevant instructions.2. This form contains references to the General Terms and Conditions of Sale, images of each product and its price, the payment methods available, the delivery methods for the purchased products, and the related shipping and delivery costs, as well as a reference to the conditions for exercising the right of withdrawal and the procedures and timelines for returning purchased products.3. Before concluding the contract, please read these General Terms and Conditions of Sale, including the information on the right of withdrawal and personal data processing.4. The contract is concluded when the seller receives the form completed by the user, subject to verification of the correctness of the data contained therein.5. The buyer is obliged to pay the price once the online order submission procedure is completed. This will occur by clicking the “PROCEED TO CHECKOUT” button at the end of the guided process.6. Once the contract is concluded, the seller will process the order for fulfillment.

Art. 4 – Registered Users

1. When completing the registration procedures, the user agrees to follow the instructions on the site and to provide their personal data correctly and truthfully.2. The confirmation will exempt tenutaorzale.it from any responsibility regarding the data provided by the user. The user agrees to promptly inform tenutaorzale.it of any changes to the data provided at any time.3. If the user provides incorrect or incomplete data or if there are disputes from interested parties regarding payments made, tenutaorzale.it reserves the right not to activate or to suspend the service until the issues are resolved.4. Upon the first request for profile activation by the user, tenutaorzale.it will assign a username and password. The user acknowledges that these credentials constitute the access validation system for the Services and the sole method to identify the user, and that the actions performed through such access will be attributed to the user and will be binding.5. The user agrees to keep their access data confidential and to store them with due care and diligence, not transferring them temporarily or permanently to third parties.

Art. 5 – Product Availability

1. Product availability refers to the actual availability at the time the buyer places the order. However, this availability must be considered indicative because, due to the simultaneous presence of multiple users on the site, the products could be sold to other customers before the order is confirmed.2. Even after sending the order confirmation email, partial or total unavailability of goods may occur. In such cases, the order will be automatically adjusted by removing the unavailable product, and the buyer will be promptly informed via email.3. If the buyer requests the cancellation of the order, thereby resolving the contract, tenutaorzale.it will refund the amount paid within no later than 30 days from the date on which tenutaorzale.it became aware of the buyer’s decision to terminate the contract.

Art. 7 – Payment Methods and Prices

1. The product prices will be those indicated on the website, unless a clear error occurs.2. In case of error, tenutaorzale.it will promptly notify the buyer, allowing confirmation of the order at the correct price or its cancellation. In any case, tenutaorzale.it will not be obliged to supply the products at the lower price incorrectly indicated.3. The prices on the site include VAT but do not include shipping costs unless explicitly stated. Prices may change at any time. Changes do not apply to orders for which a confirmation has already been sent.4. Once the desired products have been selected, they will be added to the cart. Simply follow the purchase instructions, entering or verifying the requested information at each step of the process. Order details can be modified before payment.5. Payment can be made via:

Art. 8 – Delivery

1. tenutaorzale.it ships throughout Italy.2. tenutaorzale.it will only deliver to the user’s home address provided at the time of purchase.3. Delivery is generally made within 5 working days for the Italian territory or, if no delivery date is specified, within the estimated timeframe selected during the delivery method process and, in any case, within a maximum of thirty days from the date of confirmation.4. If delivery is not possible, the order will be sent to a warehouse. In such a case, a notice will specify the location of the order and the procedure to arrange a new delivery.5. If you are unable to be present at the delivery location at the agreed time, please contact us again to arrange a new delivery date.6. If delivery cannot take place for reasons not attributable to us after thirty days from the date the order is available for delivery, we will assume you wish to terminate the contract.7. As a result of the termination, all amounts will be refunded, including delivery costs, excluding any additional costs arising from a different delivery method selected without undue delay, and in any case, within 14 days from the termination of the contract. Transportation costs resulting from contract termination may be charged to the buyer.8. Shipping costs, unless otherwise stated, are borne by the buyer and are explicitly highlighted at the time of order placement.

Art. 9 – Transfer of Risk

The risks related to the products pass to the buyer from the moment of delivery. Ownership of the products is acquired upon receipt of full payment of all amounts due in relation to the products, including shipping costs, or upon delivery if this occurs later.

Art. 10 – Warranty and Commercial Conformity

1. The seller is liable for any defect in the products offered on the site, including non-conformity of the items to the products ordered, under Italian law.2. The warranty is valid provided the defect becomes apparent within the legally prescribed terms from the date of delivery of the products. Any complaints must be submitted within a maximum of 14 calendar days from the date the defect was recognized.3. In case of non-conformity, the buyer who entered into the contract as a consumer will be entitled to have the product conformity restored at no cost through repair or replacement, or to receive an appropriate price reduction or termination of the contract for the disputed items and the consequent refund of the price.4. All costs of returning defective products will be borne by the seller.

Art. 11 – Withdrawal

1. In accordance with current legal provisions, the buyer has the right to withdraw from the purchase without penalty and without specifying the reason, within 14 calendar days as per Art. 57 of Legislative Decree 206/2005, starting from the date of receipt of the products.2. For multiple purchases made by the buyer with a single order and delivered separately, the term under point 1 starts from the date of receipt of the last product.3. The user who wishes to exercise the right of withdrawal can do so by accessing the section: RETURNS AND REFUNDS.4. The buyer must exercise the right of withdrawal by sending an explicit statement containing the decision to withdraw from the contract or alternatively by transmitting the standard withdrawal form provided in Annex I, Part B, Legislative Decree 21/2014, which is not mandatory.5. The goods must be returned to the address indicated in the appropriate section.6. The goods must be returned intact, in the original packaging, complete in all parts, and with the attached fiscal documentation. Subject to verification of compliance with the above, the site will refund the amount of the returned products within no later than 30 days. The return shipping costs are borne by the customer.7. As provided in Art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the site may withhold the refund until the goods are received or until the buyer has demonstrated having returned the goods.8. The right of withdrawal does not apply if the services and products of tenutaorzale.it fall under the categories of Art. 59 of Legislative Decree 206/2005.9. The refund will be made using the same payment method chosen by the buyer during the purchase. In the case of payment by bank transfer, if the buyer wishes to exercise the right of withdrawal, they must provide the bank details: IBAN, SWIFT, and BIC necessary for the refund.

Art. 12 – Data Processing

The buyer’s data is processed in accordance with the provisions of personal data protection legislation, as specified in the appropriate section containing the information pursuant to Art. 13 Legislative Decree 30 June 2003 and Art. 13 EU Regulation 2016/679 (Privacy Policy).

Art. 13 – Safeguard Clause

If any clause of these General Terms and Conditions of Sale is null for any reason, this will not compromise the validity and enforceability of the other provisions in these General Terms and Conditions of Sale.

Art. 15 – Governing Law and Jurisdiction

1. These General Terms and Conditions of Sale are governed by Italian law and interpreted accordingly, without prejudice to any prevailing mandatory provision of the buyer’s country of habitual residence. Consequently, the interpretation, execution, and resolution of the General Terms and Conditions of Sale are subject exclusively to Italian law.2. Any disputes arising and/or related to them must be resolved exclusively by the Italian judicial authority. In particular, if the buyer is a Consumer, any disputes must be resolved by the court of the buyer’s place of residence or domicile, based on applicable law.These terms and conditions were drafted on 21/4/2021.
